1. About these terms
These terms are an agreement between you and Naoki Nakamura ("we", "us") about your use of the BamenCue app.
By using the app you accept these terms. If you do not accept them, please do not use the app.
2. What BamenCue is
BamenCue is a scenario-based Japanese speaking-practice app. It gives you dialogues, vocabulary and audio, and it assesses the pronunciation of the replies you speak.
It is a learning aid. It is not a translation service, not a certification, and not a government, medical or legal service. It does not provide legal, immigration, medical or other professional advice.
Practice content depicts realistic everyday situations. It is not affiliated with, endorsed by, or an official statement of any public office, clinic, employer or other organisation shown in a scenario.
3. Accounts
You can use the app without an account. An account is optional.
If you create one, you sign in through a third-party sign-in provider, or with a one-time link sent to your email address. Use an address you control and keep that sign-in account secure — anyone who can sign in there can reach your BamenCue account data.
You are responsible for activity that happens under your account.
4. Acceptable use
You may use the app for your own personal, non-commercial language learning. You agree not to:
- copy, extract, republish, resell or redistribute the app's scenarios, text, audio or other content;
- reverse engineer, decompile or attempt to derive the source of the app, except where the law expressly permits it;
- interfere with, overload or attempt to gain unauthorised access to the app, our services or another person's account;
- submit content you have no right to submit, including another person's voice or personal information;
- use the app in any way that breaks applicable law.
5. Learning content and assessment limits
The practice content is learning material, not advice about your own situation, and real conversations may differ from it.
Pronunciation feedback and practice results may be inaccurate and are provided for learning purposes only. They are not a qualification, not a JLPT result and not an official assessment of your Japanese.
6. Microphone, speech and network
Speaking practice requires microphone permission and an internet connection. If either is unavailable, speaking practice will not work; other parts of the app may still be usable.
You are responsible for your device, your permissions and any data charges from your network provider. How audio is handled is described in the Privacy Policy.
7. Third-party services
Some features may depend on third-party services. See the Privacy Policy for information about data handling.
Those services are operated by their own companies under their own terms, and we are not responsible for them. The app is distributed through the Apple App Store and Google Play.
8. Intellectual property
The app, and its scenarios, text, audio, images, design and software, belong to Naoki Nakamura or its licensors and are protected by law.
We give you a personal, limited, non-exclusive, non-transferable and revocable licence to use the app for your own learning. No ownership is transferred to you, and no rights are granted other than those stated here.
9. Your recordings and text
What you say and type stays yours. You give us only the permission needed to process it in order to provide the features you choose. See the Privacy Policy for information about data handling.
10. Availability and changes
The app is provided "as is" and "as available". We may add, change or remove features, and the service may be interrupted for maintenance, technical problems, or reasons outside our control.
We may change these terms. The version and effective date at the top of this document change with them, and continuing to use the app after a change means the updated terms apply to you.
11. Disclaimers
To the fullest extent permitted by law, the app is provided without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or the accuracy of assessment results or learning content.
12. Limitation of liability
To the fullest extent permitted by law, Naoki Nakamura is not liable for indirect, incidental, special or consequential damages, for lost or corrupted data, or for any decision you make on the basis of practice content or assessment results.
Nothing in these terms limits liability that cannot be limited or excluded under applicable law, including your statutory consumer rights.
13. Ending your use
You may stop using the app at any time. Uninstalling it removes the app and the data it stored on your device.
If you signed in, Settings offers "Delete account data" to delete the data associated with your BamenCue account. What it does and does not remove is described in the Privacy Policy and in Privacy choices.
We may suspend or end your access if you breach these terms, or if we discontinue the service.
14. Languages
These terms are written in English, which is the authoritative version. Translations may be provided for other languages the app supports. If a translation and the English version disagree, the English version applies.
